Do driver facing cameras record all the time?

Is a dash cam/driver facing camera an MOT failure?
A driver facing csmera on its own will not cause an MOT failure. There’s no law against having one fitted in your vehicle. However, improper installation can lead to a failure, specifically if the camera obstructs the driver’s field of vision.
According to MOT guidelines related to dash cams, they should not obstruct the driver’s field of view by more than 4cm in the swept area of the windscreen. If this happens, it will result in MOT failure. This is why professional installation matters: to ensure dash cams are positioned correctly so they’re compliant and do not interfere with visibility.
